are pleased to introduce the new and updated regulations in 2023 on patent registration in Vietnam as follows:<\/em><\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"What-is-an-invention-patent\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong> What is an invention? (patent)<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span style=\"font-size: 20px;\">An invention is a technical solution in the form of a product or a process which is intended to solve a problem by application of laws of nature. An invention shall be protected by mode of grant of invention patent or utility solution patent.<\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"What-is-patent-registration\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong>What is patent registration?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span style=\"font-size: 20px;\">Patent registration means that the invention owner carries out procedures for filing an invention application at the Vietnam Intellectual Property Office (VNIPO) to obtain an invention patent, recognizing the exclusive ownership of invention to owners throughout the territory of Vietnam for a certain period of time. <\/span><\/p>\n<p><span style=\"font-size: 20px;\">Registration of exclusive protection for invention becomes especially important and necessary in the context of a very fiercely competitive market. Invention registration establishes a competitive advantage for businesses in the market, while also safeguarding the invention from infringements and invention \u201ctheft\u201d.<\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"Who-has-the-right-to-file-a-patent-application-for-registration\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong>Who has the right to file a patent application for registration?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span style=\"font-size: 20px;\">According to Article 86 of the Vietnam Intellectual Property Law, amended and supplemented in 2022, the following organizations and individuals have the right to register invention protection:<\/span><\/p>\n<p><span style=\"font-size: 20px;\">(a) The author or the lawful successor of the author who creates an invention using their own effort and expense;<\/span><\/p>\n<p><span style=\"font-size: 20px;\">(b) Organizations or individuals who invest funds and material resources for the author through assignment or employment, except in cases where the parties have agreed otherwise.<\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"Why-do-you-have-to-register-an-invention\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong>Why do you have to register an invention?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><a href=\"https:\/\/lawfirmelite.com\/vi\/patent-registration-vietnam\/\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-8531\" src=\"https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/07\/Y-nghia-bao-ho-2.png\" alt=\"\" width=\"800\" height=\"2000\" srcset=\"https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/07\/Y-nghia-bao-ho-2.png 800w, https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/07\/Y-nghia-bao-ho-2-768x1920.png 768w, https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/07\/Y-nghia-bao-ho-2-614x1536.png 614w\" sizes=\"(max-width: 800px) 100vw, 800px\" \/><\/a><\/p>\n<p><span style=\"font-size: 20px;\">The registration of patent protection holds four significant implications for businesses, as follows:<\/span><\/p>\n<p><span style=\"font-size: 20px;\"><em><strong>i) Firstly,<\/strong><\/em> inventions can only be legally recognized and protected by the law based on registration with the competent State authority (Vietnam IP Office). Registration of inventions grants businesses exclusive legal ownership rights over the invention throughout the territory of Vietnam. Therefore, businesses need to acknowledge the importance of protecting inventions and proceed with registration as early as possible.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 20px;\"><em><strong>(ii) Secondly,<\/strong><\/em> registration helps the owner prevent infringement and thief of their invention by competitors. By holding an invention patent, the owner can publicly disclose and widely use their invention without the fear of losing it. They have the right to be assured that no one else in the market is allowed to manufacture or use their invention without their permission.<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 20px;\"><em><strong>(iii) Thirdly,<\/strong><\/em> registering for invention protection creates a source of income for the owner. With an invention patent in hand, the owner has complete ownership of his invention: use, lease, sell, franchise. Moreover, an invention patent can even be used as collateral for bank loans to help owners have a secure budget for other investments<\/span><\/p>\n<p>&nbsp;<\/p>\n<p><span style=\"font-size: 20px;\"><em><strong>(iv) Importantly,<\/strong><\/em> the fourth implication is that you have the right and confidence to set higher prices for your products compared to competitors. This is because only your business has the exclusive right to produce and sell such unique and useful products in the market.<\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"What-are-the-conditions-for-invention-protection\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong>What are the conditions for invention protection?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span style=\"font-size: 20px;\">Invention will be protected when it fulfills the following conditions:<\/span><\/p>\n<p><span style=\"font-size: 20px;\"><strong>\u221a Having Novelty:<\/strong> The invention must have significant differences from any inventions that have been publicly disclosed through use, described in writing, or in any other form, either domestically or internationally.<\/span><\/p>\n<p><span style=\"font-size: 20px;\"><strong>\u221a Having Creativity (inventive steps):<\/strong> The invention must not be easily created by a person with average knowledge in the corresponding field.<\/span><\/p>\n<p><span style=\"font-size: 20px;\"><strong>\u221a Having Industrial applicability:<\/strong> The invention is considered to have industrial applicability if it can be used as a model for mass production of products or repeated application of the process that is the subject matter of the invention, and to achieve stable results.<\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"Which-types-of-inventions-are-protected-according-to-the-regulations\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong>Which types of inventions are protected according to the regulations?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span style=\"font-size: 20px;\">The types of invention protected under the provisions of the Vietnam Intellectual Property Law include:<\/span><\/p>\n<p><span style=\"font-size: 20px;\">\u25ca Products, in the form of<\/span><\/p>\n<ul>\n<li><span style=\"font-size: 20px;\">New devices (tools, machinery, equipment, components, etc.) are represented by a set of information that defines an artificial product characterized by structural features and functionality.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">New materials (substances, compounds, food, pharmaceuticals, etc.) are represented by a set of information that defines an artificial product characterized by the presence, proportion, and state of its elements, with specific functionality.<\/span><\/li>\n<li><span style=\"font-size: 20px;\">New drugs, pharmaceuticals, and vaccines.<\/span><\/li>\n<\/ul>\n<p><span style=\"font-size: 20px;\">\u25ca Methods and processes for producing\/manufacturing new devices, materials, or pharmaceuticals (technological processes; diagnostic, forecasting, testing, and treatment methods, etc.) are represented by a set of information that defines the procedure for carrying out a specific process or task, characterized by features related to sequence, conditions, participating components, measures, and means of achieving a specific objective.<\/span><\/p>\n<h1><span class=\"ez-toc-section\" id=\"Which-objects-are-not-eligible-for-invention-exclusive-protection-registration\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><strong>Which objects are not eligible for invention exclusive protection registration?<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<p><span style=\"font-size: 20px;\">Not all types of objects can be registered for invention protection, according to the provisions of the Vietnam Intellectual Property Law.
