1)The objective of the international preliminary examination is to formulate a preliminary and non-binding opinion on the questions whether the claimed invention appears to be novel, to involve an inventive step (to be non-obvious), and to be industrially applicable.<\/span><\/p>\n

Draft 1991 Art. 11(1)<\/span><\/p>\n

(1) [Patentability<\/u>]\u00a0 In order to be patentable, an invention shall be novel, shall involve an inventive step (shall be non-obvious) and shall be, at the option of the Contracting Party, either useful or industrially applicable.<\/span><\/p>\n
