What is “directive”?<\/span><\/strong><\/h1>\n

A type of legislative instrument in the European Union (and before it the European Communities): it is binding on the Member States as to the effect to be achieved but not as to the means for achieving it. Much used to harmonise or approximate the laws of the Member States in a variety of fields, including trade marks, copyright and neighbouring rights, and designs. Member States must implement the requirements of the Directive in national law. The experience of the UK shows that unless the domestic legislation uses precisely the same words it risks being found inadequate, but if the words are faithfully reproduced it can be difficult to assign a meaning to them.<\/span><\/p>\n
