font-size: 20px;\"> Using protected industrial designs or industrial designs insignificantly different from protected industrial designs, within valid terms of protection titles without permission of owners;<\/span><\/li>\n<li><span style=\"font-weight: 400; font-size: 20px;\"> Using industrial designs without paying compensation according to the provisions on provisional rights.<\/span><\/li>\n<\/ol>\n<h2><span class=\"ez-toc-section\" id=\"What-is-the-use-of-industrial-design\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><b>What is the use of industrial design?<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400; font-size: 20px;\">The use of an industrial design means the performance of the following acts:<\/span><\/p>\n<ol style=\"list-style-type: lower-roman;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Manufacturing products with an appearance embodying the protected industrial design;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Circulating, advertising, offering, and stocking for circulation products with appearance embodying the protected industrial design;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Importing with appearance embodying the protected industrial design products.<\/span><\/li>\n<\/ol>\n<h1><span class=\"ez-toc-section\" id=\"How-to-handle-industrial-design-infringements\"><\/span><span style=\"font-size: 20px; color: #891d1f;\"><b>How to handle industrial design infringements?<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h1>\n<h2><span class=\"ez-toc-section\" id=\"Handling-administrative-remedies\"><\/span><span style=\"font-size: 20px; color: #f58634;\"><b>Handling administrative remedies<\/b><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-size: 20px;\"><span style=\"font-weight: 400;\">According to regulations, the highest fine for individuals who infringe on the right to industrial designs is VND 250,000,000. The maximum fine for organizations that infringe the right to an industrial design is VND 500,000,000, as follows:<\/span><\/span><\/p>\n<p><a href=\"https:\/\/lawfirmelite.com\/vi\/industrial-design-enforcement-in-vietnam\/\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-9293\" src=\"https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/10\/2-Xu-phat-hanh-chinh-kieu-dang-eng.png\" alt=\"\" width=\"2010\" height=\"3610\" srcset=\"https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/10\/2-Xu-phat-hanh-chinh-kieu-dang-eng.png 2010w, https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/10\/2-Xu-phat-hanh-chinh-kieu-dang-eng-768x1379.png 768w, https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/10\/2-Xu-phat-hanh-chinh-kieu-dang-eng-855x1536.png 855w, https:\/\/lawfirmelite.com\/vi\/wp-content\/uploads\/2023\/10\/2-Xu-phat-hanh-chinh-kieu-dang-eng-1140x2048.png 1140w\" sizes=\"(max-width: 2010px) 100vw, 2010px\" \/><\/a><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Handling-civil-remedies\"><\/span><span style=\"font-size: 20px; color: #f58634;\"><strong>Handling civil remedies<\/strong><\/span><span class=\"ez-toc-section-end\"><\/span><\/h2>\n<p><span style=\"font-weight: 400; font-size: 20px;\">According to regulation, Courts shall apply the following civil measures to handle organizations and individuals that commit acts of industrial design infringement:<\/span><\/p>\n<ol style=\"list-style-type: lower-roman;\">\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Compelling the termination of infringing acts;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Compelling the public apology and rectification;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Compelling the performance of civil obligations;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Compelling the payment of damages;<\/span><\/li>\n<li style=\"font-weight: 400;\" aria-level=\"1\"><span style=\"font-weight: 400; font-size: 20px;\">Compelling destruction, distribution, or use for non-commercial purposes of goods, raw materials, materials, and means used largely for the production or trading of industrial design-infringing goods, provided that such destruction, distribution, or use does not affect the exploitation of rights by industrial design right holders.<\/span><\/li>\n<\/ol>\n<p style=\"text-align: justify;\"><span style=\"font-weight: 400; font-size: 20px;\">Civil remedies are applied to handle acts of infringement at the request of industrial design owners, organizations, or individuals who suffer from the damage caused by those acts, even when those acts have been or are being handled by administrative or criminal remedies. The procedures for a request for the application of civil remedies and the competence, order, and procedures for the application of civil remedies shall comply with the provisions of law on civil procedures.<\/span><\/p>\n<h2><span class=\"ez-toc-section\" id=\"Handling-criminal-remedies\"><\/span><span style=\"font-size: 20px;
