HOW TO RECORD A DESIGN PATENT LICENSE AGREEMENT IN CAMBODIA

1. General provisions

A trademark assignment in Cambodia must be made in writing and registered with the Trademark Office to be valid in Cambodia.

2. Required documents

• Original notarized Power of Attorney;
• Original notarized /certified copy of the Assignment Agreement;
• Original Certificate of Trademark Registration.

3. Time frame

In current practice, time frame for recordal of trademark assignment is about 04 – 05 months from the filing date

4. Cost for recordal of trademark assignment

The total cost including official fees, attorney fees and disbursements cost for the recordal of trademark assignment from the filling stage to obtaining the recordal of trademark assignment.

Recordal of trademark license

1. General provisions

Trademark license agreement must be made in writing. Trademark license agreement shall have no effect against third parties until recorded.

A recorded license agreement is valid for a maximum of five (05) years and depending on the term of the contract and validity of the trade mark(s) within the agreement. Renewal of a recorded license agreement can be filed six months prior to the expiry date of the recorded agreement.

A request for recordal of a license/franchise contract must be filed within six (06) months of the effective date of the contract. 

2. Required documents

• Original notarized Power of Attorney;
• Original notarized/certified copy of the License Agreement;
• Original of Certificate of Trademark Registration.

3. Time frame

Under Cambodia regulation, time frame to complete the recordal of license is 2 months from the filing date. However, in current practice, time frame for trademark license agreement is prolonged from 5-7 months from the filing date

4. Cost for recordal of a license agreement

The total cost including official fees, attorney fees and disbursements cost for the trademark license agreement from the filling stage to obtaining the trademark license agreement.
