HOW TO RENEWAL VALIDITY OF A TRADEMARK REGISTRATION IN CAMBODIA

1. General provisions

The registration of a mark shall be for a period of ten years from the filing date of the application for registration. The registration of a mark may be renewed for consecutive periods of ten years.

To have the validity of trademark registration renewed, the owner shall file a request for renewal and pay a validity renewal fee within six months before the expiration of the validity term. A period of grace of six months shall be allowed for the late renewal of the registration of a mark.

2. Required documents

  • A notarized Power of Attorney signed by trademark owner (under our form);
  • A copy of the latest Trademark Certificate which must be included endorsement of Affidavit of use/non-use;
  • 16 trademark samples (size not bigger than 8 cm x 8 cm) or trademark sample in JPEG or PDF format.

Notes:

  • If the Affidavit of use/non-use of the trademark has not been filed in the prescribed time, the trademark owner must file the same at the time of proceeding with renewal.

 

3. Time frame

In current practice, time frame for recordal of renewal of a trademark registration is about 02 – 04 months from the filing date

4. Cost for Renewal of Trademark Registration

The total cost including official fees, attorney fees and disbursements cost for the recordal of Trademark Registration renewal from the filling stage to obtaining the recordal of Renewal.

Recordal of amendment of trademark registration

1. General provisions

The trademark registration is amended in case there is a change in the name or address of the owner

2. Required documents

  • Original notarized Power of Attorney;
  • Original Certificate of Trademark Registration.
  • Original notarized Declaration of Change of Name/Address or legal documents showing the change of name/address;

 

3. Time frame

In current practice, time frame for recordal of trademark registration amendment is about 04 – 05 months from the filing date
