HOW TO RECORD A DESIGN PATENT LICENSE AGREEMENT IN VIETNAM

I.        REQUIRED DOCUMENTS

1. 01 Original Power of Attorney signed by either licensor or licensee (under our form);
2. 02 sets of Original Notarized License Agreement;

II.      NOTES OF LICENSE AGREEMENT

1. Only registered trademarks are recordable;
2. A license agreement must be in writing.
3. A license agreement may cover multiple registered trademarks;
4. The right to use collective marks must not be licensed to organizations or individuals other than members of the collective mark owners;
5. The licensee must not enter into a sub-license contract with a third party, unless it is so permitted by the licensor;
6. Mark licensees shall be obliged to indicate on goods and goods packages that such goods have been manufactured under mark license contracts;

 III.  TIME LIMIT

Under IP regulations, it takes 02 months for recording a industrial design patent License Agreement.
