 I. REQUIREMENTS

 

  1. Name, address and nationality of applicant and designer(s);
  2. Photographs/drawings of front, rear, left, right, top, bottom and perspective views of Industrial Design (electronic format);
  3. Certified copy of the priority document(s), if claimed;
  4. Signed Power of Attorney of applicant in favour of ELITE LAW FIRM (under our form);
  5. Signed Deed of Assignment, requested only if:
  • Applicant is individual but not the designer; or
  • Applicant is organization not the applicant stated in priority application.

 

Notes:

 

  1. Language of filing: Vietnamese;
  2. Priority data (application number, date and country) is required at filing; the original priority document is required within 03 months from filing date;
  3. Original documents (4) & (5) are required within 01 month from the filing date.

 

II. TIME LIMIT

 

  • Formality examination: 1 month from the application’s filing date;
  • Publication of application: 2 months from the application’s formality acceptance date;
  • Substantive examination: 7 months from the application’s publication date;
  • Granting a patent: 15 working days from the payment date

 

III. VALIDITY TERM

 

A Patent for Industrial Design is valid for 5 years from filing date, renewable twice, each time for 5 years.

Q&A ON INDUSTRIAL DESIGN

1. What is an Industrial Design?
Industrial design means a specific appearance of a product embodied by three-dimensional configurations, lines, colors, or a combination of these elements. Products herein are understood to mean articles, tools, equipments, or parts used for assembling such products, manufactured by industrial or handicraft methods, with a structure and clear function, be circulated independently.
2. What is the validity of a industrial design patent in Vietnam?
A Patent for Industrial Design is valid for 5 years from filing date, rewwable twice, each time for 5 years.
3. What documents are required for industrial design registration?
Applicants need to prepare the following documents to carry out the industrial design registration: (1)Name, address and nationality of applicant and designer(s); (2) Photographs/drawings of front, rear, left, right, top, bottom and perspective views of Industrial Design (electronic format); (3) Certified copy of the priority document(s), if claimed; (4) Signed Power of Attorney of applicant in favour of ELITE LAW FIRM (under our form); (5) Signed Deed of Assignment, requested only if:(a)Applicant is individual but not the designer; or(ii) Applicant is organization not the applicant stated in priority application.
4. How long is the time limit for substantive examination of an industrial design registration application?
The time litmit for substantive examination of an industrial design registration is 7 months from the application’s publication date.
