HOW TO RENEWAL VALIDITY OF AN INDUSTRIAL DESIGN PATENT IN VIETNAM

I. Required documents

1. An original Power of Attorney signed by design owner (under our form);
2. (Optional) An original Design patent in case the design owner wishes to record in the original patent. Otherwise, this document is not compulsory.

Notes:

• The design owner shall renew the validity of design patent by filing an application of renewal to the NOIP within six (06) months before the expiration date of design patent. 06 months grace period is acceptable by the NOIP and the late-filing fees will be applied.
• All the documents are required at filing time.

 II. Time limit

Under IP regulations, it takes 01 month for recordal of renewal for a design patent.
