HOW TO MAINTAIN VALIDITY OF PATENTS IN LAOS

 1. Required documents

  • An original Power of Attorney signed by the owner.

Notes:

  •  The validity of the patent/utility solution shall be maintained within six (06) months before the expiration date of registration. 06 month grace period is acceptable by the DIP and the late-filing fees will be applied;
  • A patent has a protection period of twenty years from the filing date of the application. The fee for maintaining the validity of a patent for the first four years is included in the filing fees. The owner shall pay maintenance fees from the fifth year onward;
  • A petty patent (utility solution) has a protection period of ten years from the filing date of application. The fee for maintaining the validity of the utility solution for the first year is included in the filing fees. The owner shall pay maintenance fees from the second year onward.

2. Time limit

At the time of payment of maintenance fees, the Department of Intellectual Property (DIP) shall issue an Official payment receipt for such fees. This Receipt will be considered as evidence for payment of maintenance fees.

II. AMENDMENT OF PATENT AND UTILITY SOLUTION IN LAOS

1. Required documents

  • Original notarized Power of Attorney;
  • Original notarized Declaration of Change of Name/Address or legal document showing the change of name/address;
  • Original Patent/Utility solution certificate registration

2. Time limit

In practice, the time frame to complete the record of the name/address change procedure is about 5-7 months from the filing date in Laos.
