Seminar on “Evaluation of infringement elements of inventions”

On March 15, 2019, the Institute of Science and Intellectual Property in collaboration with Japan External Trade Organization (JETRO) and Japanese Southeast Asia Intellectual Property Network on trade and industry (SEAIPJ) organized a seminar on “Evaluation of infringement elements of inventions”.

Attending the seminar, on Japanese side, there was JETRO representatives (Mr. Norihisa Kato, Mr. Kenichi Kobiki, Mr. Takaharu Tateishi), representatives of SEAIPJ (Mr. Shigehiro Kondo – Yamaha Motor Company, Mr. Atsushi Iwakiri – Panasonic Group, Mr. Mamoru Usuda – YKK Company). On Vietnamese side, there were Mr. Nguyen Huu Can – Deputy Director of Vietnam Intellectual Property Research Institute (VIPRI) with the leadership, officials and representatives of the state management agencies on intellectual property, institutes,  and industrial property representative organizations.

Mr. Nguyen Huu Can and Mr. Norihisa Kato affirmed that in the context that infringements of inventions are becoming more and more complicated, the analysis and determination of infringing elements of inventions, including determination of the scope of patents, evaluation the likelihood of similarity/equivalence of patents must base on scientific basis, legal basis, uniformly understanding and application.

At the seminar, Representatives of SEAIPJ and VIPRI had a presentation on laws, principles and practices in defining infringements of patent rights. Each side had presented typical cases to introduce the method to determine whether the suspected product infringes the rights of protected invention.

After the presentation, participants had joined actively in the discussion that lasted more than an hour. Many questions and comments were raised for both Japan and Vietnam. In particular, delegates was interested not only in the way of determining the infringing elements but also the experience of handling infringement rights in specific cases. In addition, a number of delegates also provided more special cases in the actual assessment of infringement rights nowadays.

Mr. Nguyen Tran Tuyen, as a representative of ELITE LAW FIRM, also attended and gave questions and comments on patent infringements in Vietnam at the seminar.

At the end of the seminar, representatives of the two parties affirmed the important role of identifying elements/infringements of rights to inventions in the enforcement system and said that the Seminar had provided many useful information for related parties. The two sides also expressed their desire to continue cooperation and exchange of experience in the field of intellectual property in the coming time.
