The Vietnam Intellectual Property Office (VNIPO) issued Notice No. 1884/TB-SHTT dated June 28, 2024, on the implementation of Circular No. 43/2024/TT-BTC dated June 28, 2024 of the Ministry of Finance.
On June 28, 2024, Vietnam’s Ministry of Finance issued Circular No. 43/2024/TT-BTC regulating the collection rates of some fees to continue removing difficulties and supporting production and business activities. Some points to note in Circular No. 43/2024/TT-BTC effective from July 1, 2024, are as follows:
- For procedures related to industrial property registration received by the VNIPO from July 1, 2024, to December 31, 2024, and procedures in the process of handling IP applications previously received by the VNIPO has a notice with the content of fee payment issued by the VNIPO from July 1, 2024, to December 31, 2024, types of industrial property fees prescribed in section A Schedule of industrial property fees and charges issued together with Circular No. 263/2016/TT-BTC dated November 14, 2016 of Vietnam’s Minister of Finance stipulating the Fees and charges for registration for the protection of industrial property right from 2017 (hereinafter referred to as “Circular No. 263/2016/TT-BTC”) will be reduced by 50%.
- In case organizations and individuals submit applications and documents related to industrial property registration online, fees and charges shall apply as prescribed in Circular No. 43/2024/TT- BTC does not apply the fees and charges specified in Circular No. 63/2023/TT-BTC dated October 16, 2023 of the Minister of Finance amending and supplementing some articles of some Circulars regulating regulations on fees and charges of Vietnam’s Minister of Finance to encourage the use of online public services (hereinafter referred to as Circular No. 63/2023/TT-BTC).
- For cases with a notice with fee payment content issued by the Vietnam Intellectual Property Office before July 1, 2023, the fee payment shall be made according to the rate set in the issued notices.
- From January 1, 2025, onwards, the collection of fees and charges shall comply with Circular No. 263/2016/TT-BTC, Circular No. 63/2023/TT-BTC and amending Circulars. change, supplement, or replace (if any).
