Notification of the Copyright Office of Vietnam on procedures for registration of copyrights and related rights according to Decree No. 17/2023/ND-CP effective as of April 26, 2023

According to Decree No. 17/2023/ND-CP effective as of April 26, 2023, procedures for granting, reissuing, and renewing Copyright Registration Certificates and Related Rights Registration Certificates are According to Decree No. 17/2023/ND-CP effective April 26, 2023, procedures for granting, reissuing and renewing Copyright Registration Certificates and Related Rights Registration Certificates are regulated and adjusted as follows:

1. The time limit for reviewing, classifying, and considering the validity of the dossier is 01 months from the date of receipt of the Application dossier (Application);
   1. In case the Application is not valid (not acceptable), the competent Atate Agency (the Copyright Office of Vietnam, COV) shall notify and request the Applicant (organization or individual who filed the application) to amend and supplement the Application as required. The Applicant shall have a maximum period of 01 months from the date of receipt of the Notification (from the COV) to amend and supplement required documents, except in the case of force majeure events or objective obstacles as prescribed by law.
   2.  In case the Applicant does not amend or supplement the Application or has amended or supplemented the Application but the Application (after amending or supplementing) is still invalid, the COV shall return the Application to the Applicant.
2. For procedures for granting a Certificate of Copyrights Registration, a Certificate of Related Rights Registration: if the application is valid according to regulations, within 15 working days, the COV shall be responsible for granting the Certificate of Copyrights Registration, Certificate of Related Rights Registration.
3. For procedures for reissuing a Certificate of Copyrights Registration, a Certificate of Related Rights Registration: if the application is valid according to regulations, within 7 working days, the COV shall be responsible for reissuing the Certificate of Copyrights Registration, the Certificate of Related Rights Registration.
4. For procedures for renewing a Certificate of Copyrights Registration, a Certificate of Related Rights Registration: if the Application is valid according to regulations, within 12 working days, the COV shall be responsible for renewing the Certificate of Copyrights Registration, the Certificate of Related Rights Registration.
